The State of Alabama  Probate Court Specials term holden on the 
Clarke County   first day of November AD 1853.
 
 

Nancy Daffin widow and heir of James Daffin deceased having declined taking upon herself the administration of the estate of her husband, the said James Daffin, Deceased and recommends that 
E.J. Doty be appointed Administrator.

Daffin JA is ordered by statement that Edmond J. Doty be and is his appointed administrator of the estate of James Daffin deceased and that he give bond and security in the sum of seven thousand dollars which being done accordingly with George Walker . Jackson Daffin and Nathan Blackwell, Jr. as securities. It is therefore ordered that the bond be approved of.
 

Daffin JA is ordered by the court that Seth S. Parker , Richard P. Comaz (sp?) , David Blackwell, Nathan Blackwell,Jr and Allen Walker be appointed appraisers of the property belonging to estate of James Daffin deceased and that the admin E.J. Doty admin return of an inventory and the appraisement  to the court within the time prescribed by law.

Figsnes, James B. is ordered by the court that Derusha Daffin be appointed administrator of the estate of JamesBA. Figsnes ( Figsmes SP?) deceased and that he give bond and security in the sum of fourteen hundred dollars which being done accordingly with John R. Bimphus and Nathaniel C. Gordon  as securities. It is therefore ordered that the bond be approved of and that letters of administration ---pare to said D. Daffin.

JA is ordered that Henry W. Burg, William P. Williams, J.B. Pogerforo(sp?) ,A Coate be appointed appraisers of the property belonging to estate of James B or P Figsmes deceased. That the administrator of D. Daffin returns an inventory of such property to this court within the time prescribed by law.

Daffin JA is ordered by the court that the inventory and appraisement of the property belonging to the estate of James Daffin deceased is rendered by E.J. Doty Administrator be received recorded and filed.

Daffin  On the application and petition of E.J. Doty Administrator  of Estate of James Daffin deceased . It is ordered by the court that said E.J. Doty Administrator of Estate of James Daffin deceased, be authorized to sell at public auction on the promises after giving the lawful notice. The perishable property belonging to said estate consisting of stock cattle hogs, horses, wagon, clock.

Daffin: This day came E.J. Doty Administrator of the estate of James Daffin Deceased and filed his petition in open court as the law requires set ----ing the court to grant an order authorizing him to sell the following Negroes slaves Emit, Dolly and Ann, belonging to said estate and distinguishing which petition sets forth that George Daffin and Mary Smmes wife of Smith Simmes and on resident heirs of said estate. It is therefore ordered by the court that at least this accompanies makes notice of said appreciation’s be given publication in the Grove Hill Herald a newspaper printed in Clarke County. That said petition will be heard and determined on at the off ice of the judge of the probate court of Clarke County on the 23rd day of December  next, at which time and place all persons interested may attend if they wish.

James Daffin Estate  Petition for sale of land
In the matter of   EJ Doty Administrator of the estate of James Daffin deceased.

Has filed in this court his petition imploring this court to grant him an order authorizing him to sell the land which the said James Daffin deceased grant seized and  ---- of in Clarke County for the purpose of a non-equal distribution among the heirs and distributors., alleging that said land cannot be equally and fairly divided among the heirs consistent of sale of the same petition from this sets forth shall Nancy Daffin , the widow and wife of said decedent has relinquished all her rights to powers in the land and consents  and agrees to that the whole of it be sold. That she only claims a child’s part of the purchase money thereof. Petition further sets forth the following names of all the heirs and distributing to wit: Mrs Nancy Daffin his widow, John Daffin, Jackson Daffin, Andrew Daffin, E. J. Doty in right of his wife Ann and Derusha Daffin all of whom are of full age and reside in Clarke County, Ala. The minor heirs of Oran Daffin who reside in Clarke County. George Daffin of full age, residence not known to petitioner. Smith Simmes in right of his wife Mary of Scott Co, Mississippi of full age and George Dupentuis* in right of his wife Rebecca of full age who resides in Mobile County, Ala.  It is therefore ordered by the court that at least four make notice of the filing of said petition by publication in the Grove Hill Herald

a newspaper printed in Clarke County so as to notify the said non resident heirs named in said petitions that the same will be heard and determined on at the office of the Judge of the Probate Court of Clarke County on the 11th day of January wit. At which time and place all persons in any ways interested may attend and contest if they think proper. It is further ordered that notices ----- to the resident heirs of the timed place of hearing said petition. It is further ordered that Henry --. Burgs be appointed Guardian Ad Litems for the minor heirs of Oran Daffin deceased and that he also give legal notice of said applications.

*Rebecca Daffin married George Dupentuis in Mobile, Alabama on March 8, 1853.

Absalom Rodgers Estate      Application for Dower
In the matter of      This day it being the day and term of the court to which the hearing of the petition of Eleanor Rodgers for dower was postponed . It appears by petition that all the heir are of full age except John Rogers who is a minor under the D. Daffin was appointed Guardian Ade litem for said John Rodgers and was notified of the same. And all the heirs being residents of Clarke County, those of full age signed a motion consent that the said Eleanor Rodgers might have her Dower set off which motion consent waved any notice by citation. And now on this day no person or persons appeared to contest or object to the applications of said Eleanor Rodgers for Dower on---- (didn’t get the rest of this record)
